I had L4-L5-S1 Back Fusion on Feb 21 2011 due to years of back pain. My pain now is much worse than before and now I have continuous left foot/leg pain which I never had before the surgery. While in the hospital my left foot was in extreme pain, and it was caused because the drain that the doctor inserted during surgery was put in my sciatic nerve canal. My doctor apologized for the misplacement. Once the drain was removed, the extreme foot pain went away, but I still have this left foot/leg pain. I think this pain is caused by scarring, caused by improper insertion of the drain tube. I would like to investigate my options. I am still having to undergo spinal injections to try to lessen the pain and am going to be overseas for 5 months. I'm wondering if I can pursue options when I return (17 months after the surgery) and if you think there may be possibility of compensation. I am much worse than before the surgery and never experienced leg/foot pain prior to the surgery. I first started going to the one in Riverside On Indiana a few years ago. I have had an on-going problem with my teeth underneath my crowns going bad so no news there. Everything was going okay until they changed their whole office over - Drs & front office people. I had a few consults about the teeth that needed to get extracted because they kept on getting it wrong. Ok - so sitting in chair ready to get teeth extracted & the Surgeon whom is the same one I dealt with in the past & love him reaffirmed the teeth & I said they left one out on the chart. He said he couldn't extract it until the Dr came in & approved it & could I wait 1 hr for that. This is after I had already reaffirmed a few times with the front office which teeth they were going to do!! Obviously they didn't write up on chart correct!! Geez - what a surprise!!! So I couldn't wait so left to come back another day. Many dentists now work as private practices or in conjunction with a larger private healthcare scheme. While the certificate of merit may be set forth based based solely on allegations that other licensed professionals for whom this defendant is responsible deviated from an acceptable professional standard, it is more common for an appropriate licensed professional to set forth a written statement alleging a reasonable probability that the care, skill or knowledge exercised or exhibited in the treatment fell outside acceptable professional standards and that such conduct was a cause in bringing about the harm. Alternatively, the certificate of merit may allege that such testimony is unnecessary to prove the claim. An appropriate licensed professional is not required to be the same doctor or expert witness who will testify at trial. However, the individual must be an, expert with sufficient education, training, knowledge and experience to provide credible, competent testimony. A common legal pitfall at this stage of trial is alleging that an expert is not necessary only to find later in the proceedings that the burden cannot be carried without expert testimony.
